Unless you and EHE enter into a separate written confidentiality or submission agreement signed by authorized representatives of both parties, your submission of Your Material is voluntary and not confidential, and EHE does not agree to refrain from using any element of Your Material that is not protected by applicable intellectual property law.

You are solely responsible for Your Material, and you represent and warrant that you have all rights necessary to submit Your Material and to grant the rights granted in these Terms. Subject to the arbitration option below if EHE elects to include it, you agree to submit to the personal jurisdiction of the state and federal courts located in Los Angeles County, California for any legal proceeding arising out of or relating to these Terms, the Website, or the Services.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or the Services will be resolved by binding arbitration administered by AAA in Los Angeles County, California, before one arbitrator, except that either party may seek temporary, preliminary, or permanent injunctive relief in a court of competent jurisdiction to protect intellectual property, confidential information, or proprietary rights. The arbitrator will have authority to award any relief available in court, subject to the limitations and exclusions in these Terms. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
